Energy Transfer Marketing & Terminals, L.P.

Energy Transfer Marketing & Terminals, L.P. (ETMT; formerly Sunoco Partners Marketing & Terminals, L.P. [SPMT]), processes, stores, and distributes natural gas liquids (NGLs) at its Marcus Hook Terminal (MHT; formerly Marcus Hook Industrial Complex [MHIC]) facility, which is located in Marcus Hook Borough, Delaware County.

Sunoco, Inc. (R&M), previously owned the facility and operated it as a petroleum refinery until 2011. SPMT acquired the idled petroleum refinery in early 2013 and redeveloped it into the MHIC, a NGLs hub on the U.S. East Coast. (On March 1, 2022, the company and facility names changed to ETMT and MHT, respectively.) ETMT receives NGL feedstock (i.e., ethane, propane, and butane) at its MHT facility via pipeline from the Marcellus Shale region, and processes, stores, and distributes the NGLs to local, regional, and international markets.

Public Participation

DEP hosted an informational meeting on June 8, 2022, in Marcus Hook Borough. DEP invited representatives from ETMT to explain the ethane processing expansion project proposed in its application for Plan Approval No. 23-0119K, and both groups answered related questions from the public. Below are links to information associated with the informational meeting:

On August 5, 2023, DEP published a notice of intent to issue Plan Approval No. 23-0119K in the Pennsylvania Bulletin (PDF, pages 4456–4458) and initiated a public comment period. On August 7–9, 2023, ETMT published a notice of DEP’s intent to issue Plan Approval No. 23-0119K in the Delaware County Daily Times (PDF).

On September 19, 2023, DEP held a combined public meeting and hearing regarding Plan Approval No. 23-0119K in Boothwyn, PA (PDF). During the public meeting, representatives from ETMT and DEP provided a brief explanation of the proposed ethane processing expansion project and permitting process, respectively, and answered associated questions from the public. Following the meeting, DEP held the public hearing to receive oral and written testimony regarding DEP’s intent to issue Plan Approval No. 23-0119K.

The public comment period for Plan Approval No. 23-0119K closed on September 29, 2023.On October 14, 2023, DEP published a notice of intent to issue the significant modification to TVOP No. 23-00119 in the Pennsylvania Bulletin (PDF, pages 6496–6498) and initiated a public comment period. On October 17–19, 2023, ETMT published a notice of DEP’s intent to issue the significant modification to TVOP No. 23-00119 in the Delaware County Daily Times (PDF).

On November 14, 2023, DEP held a public hearing in Marcus Hook Borough to accept oral and written testimony on the significant modification to TVOP No. 23-00119 and the proposed revision to the Commonwealth’s State Implementation Plan.

The public comment period for the significant modification to TVOP No. 23-00119 closed on November 24, 2023.

DEP Issued Permits and Plan Approvals

The ETMT MHT facility is currently permitted under a Title V Operating Permit ([TVOP] No. 23-00119) and three Plan Approvals (Plan Approval Nos. 23-0119E [revised], 23-0119J, and 23-0119K). A plan approval is required for the construction, shakedown, and/or performance testing of most projects that take place at this facility, while the TVOP is required for the continued operation of the air emission sources at a major facility. The TVOP consolidates applicable regulations and plan approvals into one document and does not adopt any new regulations.

Significant Modification to TVOP No. 23-00119:
On March 15, 2024, DEP approved a significant modification to TVOP No. 23-00119 to establish alternative Reasonably Available Control Technology requirements and emission restrictions, pursuant to 25 Pa. Code § 129.114(c) (referred to as “case-by-case RACT III”), for certain sources of volatile organic compounds (VOCs) at the MHT facility that commenced operation on or before August 3, 2018, and were not previously subject to or evaluated under RACT. The significant TVOP modification did not result in any VOC emissions increases or changes to any previous TVOP conditions.

Plan Approval No. 23-0119E [Revised]:
DEP issued Plan Approval No. 23-0119E [revised] to address an Environmental Hearing Board adjudication that DEP reevaluate all past authorizations for sources and equipment related to the NGLs processing, storage, and distribution operations at the MHT facility as a single aggregated project to determine the applicability of Prevention of Significant Deterioration (PSD) and New Source Review (NSR) requirements. The Plan Approval addressed NSR requirements for the single aggregated project (including the sources and equipment under Plan Approval No. 23-0119J, which was issued concurrently) and incorporated the requirements of previously-unincorporated Plan Approval Nos. 23-0119D and (the original) 23-0119E.

On February 15, 2023, DEP extended Plan Approval No. 23-0119E [revised] for the redesign/modification of existing fractionation tower 15-2S T-4 (Source ID 090) to operate as a depropanizer, in accordance with the specifications in the application for (the original) Plan Approval No. 23-0119E and the conditions in Plan Approval No. 23-0119E [revised].

Plan Approval No. 23-0119J:
DEP issued Plan Approval No. 23-0119J for the installation and use of various sources and equipment under “Project Phoenix” to accommodate the processing, storage, and distribution of approximately 140,000 barrels per day (bbl/day) of refrigerated ethane at the MHT facility.

On February 7, 2024, DEP extended Plan Approval No. 23-0119J to continue installation and use of the of sources and equipment under “Project Phoenix.”

Plan Approval No. 23-0119K:
On April 18, 2024, DEP issued Plan Approval No. 23-0119K for the installation and use of various sources and equipment under the “Ethane Chilling Expansion Project” to increase the existing processing, storage, and distribution capacity of refrigerated ethane at the MHT facility from approximately 75,000 bbl/day to approximately 85,000 bbl/day. The Plan Approval addressed PSD and NSR requirements for the Ethane Chilling Expansion Project and the single aggregated project reevaluated under Plan Approval No. 23-0119E [revised] together as an expanded single aggregated project.
