During this phase of the process, an applicant submits pre-application materials to DEP, the applicant and DEP’s siting team (consisting of regional and central office DEP staff with expertise necessary for the review of hazardous waste-related permit applications) participate in a pre-application meeting and field visit of the proposed site, and a meeting summary is prepared and distributed.
On October 2, 2018, DEP received pre-application materials from MAX Environmental Technologies, Inc. for a proposed Hazardous Waste Landfill No. 7 at its Yukon Facility.
On November 28, 2018, DEP issued a letter summarizing a pre-application meeting that was held on November 13, 2018, to discuss the siting of the proposed Hazardous Waste Landfill No. 7.
During this phase of the process, the applicant submits the following application materials: exclusionary siting criteria information (Module 9, Sections A, B and C), part A of the hazardous waste permit application, geology and soils information (if applicable), and compliance history. DEP’s siting team then reviews the submitted information for completeness. Once DEP has deemed the application administratively complete, DEP will hold at least one public information meeting and a public hearing on the complete application. The siting team then makes a decision on site suitability. If the site meets exclusionary criteria, the process continues.
On March 31, 2021 and through its consultant, MAX Environmental Technologies, Inc. (MAX) submitted exclusionary siting criteria information to DEP. On May 7, 2021, DEP determined the application to be administratively incomplete and returned the application.
On February 25, 2022 and though its consultant, MAX resubmitted its Phase I Application to DEP. On April 5, 2022, DEP determined the application to be administratively incomplete and returned the application.
On July 13, 2022 and through its consultant, MAX resubmitted its Phase I application to DEP. In addition to this submission being housed on this webpage, it will also be located for public review at the office of South Huntingdon Township, 75 Supervisor Drive, West Newton, Pennsylvania 15089. MAX has submitted this information as part of its application for a modification of its existing hazardous waste treatment and disposal permit at its Yukon facility (Permit No. PAD004835146) that would allow for disposal of hazardous waste at a new Landfill No. 7.
On August 15, 2022, DEP sent a letter to MAX indicating items that must be addressed so that DEP could determine if the application is administratively complete. In addition to this submission being housed on this webpage, it will also be located for public review at the office of South Huntingdon Township, 75 Supervisor Drive, West Newton, Pennsylvania 15089. On September 21, 2022 DEP sent a letter to MAX indicating that it had finished its administrative completeness review and accepted the application for Phase I Exclusionary Siting Criteria technical review. DEP published notice that it deemed the application administratively complete in the October 15, 2022 edition of the
Pennsylvania Bulletin. DEP also published notice of a public meeting, public hearing, and public comment period in the October 29, 2022 edition of the
Pennsylvania Bulletin.
On October 28, 2022, MAX submitted an application amendment which includes revised drawings.
On November 2, 2022, DEP issued MAX a technical deficiency letter.
On December 16, 2022, DEP issued MAX a second technical deficiency letter.
On December 19, 2022, MAX responded to DEPs first technical deficiency letter.
On January 30, 2023, MAX responded to DEP's second technical deficiency letter.
On February 17, 2023, MAX submitted a letter withdrawing the Phase I Application for Hazardous Waste Landfill No. 7 and DEP responded with a letter confirming the withdrawal.
