DEP reviewed a plan approval application—that was later modified—for the construction and initial operation of the facility. DEP’s review is highly technical and complex, requiring reviews and modeling by technical staff in DEP’s Southwest Regional Office and Harrisburg Central Office. After a thorough and complete review of the application and determination that the proposed activity can be done in a manner that complies with applicable rules and regulations—including the health-based National Ambient Air Quality Standards—DEP generates a plan approval that includes specific conditions, including monitoring and reporting.
On September 29, 2021, DEP received a request to withdraw PA-63-00922D for the proposed Beech Hollow Energy Project at the request of the applicant, Robinson Power Company, LLC. DEP terminated all authorizations associated with PA-63-00922D on September 29, 2021.
On August 23, 2021, modified plan approval 63-00922D [authorization ID 1261667] was withdrawn at the request of the applicant, Robinson Power Company, LLC.
On June 14, 2021, DEP issued modified air quality plan approval [63-00922D].
On October 23, 2020, DEP extended modified plan approval 63-00922D (authorization ID 1329351) to allow continued construction. This extension expires on March 28, 2022.

On October 4, 2018, DEP approved a revision to the plan approval to remove duct burners and modify the compliance method for the fuel sulfur limit for the proposed Beech Hollow Energy Facility. Public notice was published in the October 20, 2018 edition of the

In accordance with the federal Clean Water Act, DEP permitting establishes limits on what can be discharged, monitoring and reporting requirements, and other provisions to ensure that the treated industrial wastewater discharge does not harm water quality or pose a threat to public health.

On August 11, 2020, DEP issued an individual NPDES Permit for discharges of stormwater associated with construction activities at the generation site.
Robinson Power Company, LLC’s consultant provided a number of responses and submittals to DEP’s technical deficiency letters (TDL) in addition to the permit application.
As of December 15, 2020, Robinson Power Company, LLC has withdrawn its Chapter 102 individual NPDES permit application for discharges of stormwater associated with construction activities [PAD630045]. A Chapter 105, General Permit Registration was withdrawn by the Washington County Conservation District. The application was submitted on September 4, 2019 and during the course of its review DEP issued technical deficiency letters on November 15, 2019 and September 30, 2020.
