Office Responsibilities
Delegated County Conservation Districts – CH 105 General Permits 1-9 (Only delegated counties)
DEP Regional Offices – Chapter 105 & 106 Permits and 401 Water Quality Certifications not delegated to other offices
Regional Permit Coordination Office – Large Chapter 105 projects that cross multiple counties or regions, and oil and gas projects regulated by the Federal Energy Regulatory Committee (FERC) and 401 Water Quality Certifications for FERC regulated projects.
DEP Oil and Gas – Chapter 105 and 106 permitting and 401 Water Quality Certifications for those oil and gas activities regulated by PA oil and gas regulations.
DEP Active and Abandoned Mining Operations – Chapter 105 activities under their program’s regulated mining activities.
Division of Wetlands Encroachment and Training – Chapter 105, 106, and 401 Water quality certification regulations, policy, and guidance; legacy sediment removal; compensatory mitigation in-lieu fee and banking programs.
Division of Dam Safety – Chapter 105 regulated dams
Division of Flood Protection – DEP’s flood protection program

Chapter 105 General Permit review of certain general permits is delegated to some county conservation districts that have assumed the delegation.
Note: county conservation districts are not delegated to review General Permits 10, 11, or 15. The attached map shows which county conservation districts are delegated.

DEP Regional Offices – Waterways and Wetlands Programs
The waterways and wetlands programs in DEP’s six regional offices process all general permits that are not reviewed by delegated county conservation districts, Chapter 105 individual permits, Chapter 106 permits, and 401 Water Quality Certifications.

DEP’s Oil and Gas Programs and offices handle Chapter 105 and 106 permitting for those oil and gas activities regulated by this program under DEP’s oil and gas regulations. If your project falls within these parameters or you are unsure, you can
contact the appropriate DEP Oil and Gas Office.
Active and Abandoned Mine Operations
DEP’s active and abandoned mine operations are delegated to issue Chapter 105 for mining activities they already regulated.

Division of Wetlands Encroachment and Training
The Division of Wetlands Encroachment and Training handles the processing of all Submerged Lands License Agreements and Sand and Gravel Royalty agreements for Chapter 105, reviews legacy sediment removal restoration approvals, reviews all mitigation banking permits, oversees the in-lieu fee program, provides technical support, and is responsible for the development of regulations, procedures, manuals, and guidance related to Chapter 106, Chapter 106, and 401 Water Quality Certification.
